Terms & Conditions

By accepting a quote from and engaging FAST AOC Pty Ltd, trading as FAST Aviation (“FAST Aviation”), to undertake a charter or scenic flight, you (the “client”) and your passengers are agreeing to the following terms & conditions:

Passenger and baggage weights, and baggage size, will be agreed on at the time of quotation. These may be limited for safety reasons, and as such any increase in these weights or sizes may or may not be able to be accommodated. Items of baggage that are deemed to be of an unacceptable weight or size will not be allowed on the aircraft.

On acceptance of the quote, a deposit of 20% of the quoted price is payable to reserve the aircraft and crew. The balance of the quoted price, received as cleared funds in FAST Aviation’s bank account (NAB), is then due 72 hours prior to the scheduled departure date. If a quote is accepted within 72 hours of departure, then 100% of the quoted price is payable immediately on acceptance of the quote, and confirmation of payment must be provided to FAST Aviation prior to departure.

By accepting a quote and presenting for conveyance by FAST Aviation, clients note and accept that operational circumstances such as weather and equipment malfunction may necessitate the cancellation, postponement or diversion of a flight. The pilot in command carries the ultimate responsibility for the safety of the aircraft and its occupants, and has the absolute discretion and authority to make the decision to cancel, postpone or divert a flight if required by prevailing operational circumstances.

Aircraft type may change at the last minute due to operational considerations.

Cancellation Policy

 In no event will FAST Aviation be liable for any indirect, incidental or consequential costs borne by the client or its passengers as a result of any flight delays, cancellations or diversions.

If after formal acceptance and payment of a quote, a flight is cancelled by a client in the absence of a weather issue or aircraft unserviceability, then the following cancellation fees will apply:

A) Cancellation with more than 72 hours notice prior to the first departure – 20% of the quoted price.

B) Cancellation with less than 72 hours but more than 24 hours notice prior to the first departure – 50% of the quoted price.

C) Cancellation with less than 24 hours notice prior to the first departure – 100% of the quoted price.

If an aircraft unserviceability results in the cancellation, diversion or postponement of a flight, then:

A) Unless the client elects to postpone the flight, if the flight is cancelled prior to departure from the location where the first passengers or freight are picked up, the client will receive a 100% refund of moneys paid to FAST Aviation for that task. FAST Aviation will bear no liability for any other direct, indirect or consequential costs incurred by the client or its passengers as a result of this cancellation.

B) If the unserviceability prevents departure from the location where the first passengers or freight are to be uplifted, and the client elects to postpone the flight, then the quote will remain valid for a period of 90 days from the original date of departure and no further cost will be incurred by the client if they reschedule their flight within this 90 day period. If the flight has not proceeded within this 90 day period, the quote will expire and all moneys paid by the client will be completely refunded. FAST Aviation will bear no liability for any other direct, indirect or consequential costs incurred by the client or its passengers as a result of this postponement.

C) If the flight is diverted or postponed after departure from the location where the first passengers or freight are picked up, and the quoted task is then subsequently completed using the same aircraft, any additional direct costs (e.g. extra flight time, client accommodation) associated with this diversion or postponement will be borne by FAST Aviation. FAST Aviation will not be liable for any indirect or consequential costs incurred by the client or its passengers as a result of this diversion or postponement.

Poor Weather Policy

 If weather forecasts and/or reports indicate that there is doubt about whether or not a particular task can be completed, or a particular destination reached, then the pilot in command will discuss this with the client prior to departure from the aircraft’s home base (Lismore NSW). The client will have the option to cancel or postpone the flight prior to the aircraft leaving it’s home base.

Following this discussion:

A) If the flight is cancelled by the client prior to the aircraft leaving it’s home base, the client will receive a 100% refund of moneys paid to FAST Aviation for that task. FAST Aviation will bear no liability for any other direct, indirect or consequential costs associated with this cancellation.

B) If the client elects to proceed with the flight, and indeed the prevailing circumstances do prevent the completion of the task, or the reaching of a particular destination, then the direct and indirect/consequential costs associated with this outcome will be borne entirely by the client, and no refund will be issued by FAST Aviation.

Credit Card Cost Recovery Policy

Invoices (including invoices for flight training services) that are paid with credit card will attract a credit card cost recovery surcharge of 2.5% plus GST of the value of the transaction.
